UK judge tosses part of lawsuit against band The 1975 for gay kiss at Malaysia festival
A London judge has ruled that members of the British band The 1975 cannot be held personally liable for the losses incurred by a Malaysian music festival that was shut down after the band's lead singer, Matty Healy, kissed a male bandmate on stage. The Good Vibes Festival organizer, Future Sound Asia (FSA), is seeking £1.9 million (US$2.4 million) in losses following the incident, which occurred after Healy criticized Malaysia's anti-homosexuality laws during the Kuala Lumpur show in July 2023.
The lawsuit filed by FSA against The 1975 Productions LLP and its four members alleged breach of contract and a failure in their duty of care. However, the judge sided with the band's lawyer, who argued that the suit should only target the company, not the individual musicians. The judge dismissed the claims against the band members, calling them "bad as a matter of law," while allowing the case against the company to proceed and ordering FSA to pay £100,000 (US$126,000) in legal costs. FSA's lawyer claimed the band had promised to adhere to local guidelines after initial concerns about Healy's past drug addiction nearly prevented their performance.
