East China court rules that AI-generated image should have copyright protection
A court in Jiangsu province, China, has ruled that AI-generated content can be protected by copyright, marking the second such case in mainland China. The Changshu People’s Court determined that an image created using Midjourney qualified for copyright protection due to the user's "unique selection and arrangement" in modifying prompts and refining image details.
The case involved a plaintiff, Lin, who created an image of a heart-shaped balloon using Midjourney and later sued two companies for unauthorized use of the design on social media. The court ordered the defendants to issue a public apology and pay Lin 10,000 yuan (US$1,380) in damages. This ruling follows a similar decision by the Beijing Internet Court in late 2023, which recognized an AI-generated image as a copyrighted artwork based on the "originality" and intellectual input of its human creator, setting a precedent for intellectual property rights in AI-generated content.
